General terms and conditions of sale
Premise
The offer and sale of products on the website https://italiacbd.it are governed by the following general conditions of sale. The products purchased on the site are sold by:

Definitions
"Client" it is the purchaser of the Products who holds the status of consumer, meaning the natural and legal persons who make the purchase and act for purposes unrelated to any entrepreneurial or professional activity carried out;
"Price" are the costs of the Products indicated on the site;
"Delivery cost" are the shipping costs of the Products;
"Promotions" are the sales made by Agritek s.s.a. under special conditions for all or part of the Products and for limited periods of time;
"Cart" it is the virtual container on the site of the Products selected by the Customer for purchase;
"Conditions of sale" are the rules here reported that govern the relationship between the customer and Agritek s.s.a. for the purchase of the Products.
"Delivery": delivery times fall within a range from a minimum of 1 days to a maximum of 10 working days.
 
Object
These Conditions of Sale govern the relationship between the Customer and Agritek s.s.a. for the purchase of Products on the Site. The Customer is required to carefully read the Conditions of Sale that Agritek s.s.a. also makes available to him in order to allow him to reproduce and store the aforementioned Conditions in compliance with the provisions of art. 12, co. 3 ° of Legislative Decree no. 70/2003.
 
How to purchase
To purchase the Products, the Customer must register by entering their personal details, following the instructions provided for in the registration program, and must complete and send to Agritek s.s.a. the purchase order form in electronic format available on the site, following the instructions contained on the Site. Purchase orders must be filled out exactly in their entirety.
The Customer must insert the selected Product / s in the appropriate "Cart" and, after having viewed and accepted the contribution for the delivery costs, can proceed with the purchase.
If the Customer needs to modify the purchase order or to modify some of the data contained therein, he will have to follow the appropriate modification procedure contained on the site, in case of assistance contact info@italiacbd.it
Once this operation has been completed, the Customer will see a screen containing the summary of the purchase order, including the delivery costs, with the request for further confirmation of the purchase procedure. After viewing the summary, the Customer must select the type of payment desired and "click" the "Place Order" button.
 
Conclusion of the contract
With the confirmation of the purchase order by the Customer, the conditions of sale and additional information contained on the site will be considered fully known and accepted by the Customer.
The Order Confirmation by Agritek s.s.a. sent to the Customer at the indicated e-mail address will constitute acceptance of the contract proposal. The contract will be concluded, and will be binding on both parties, when the Order Confirmation is sent to the Customer. The Order Confirmation sent by email from Agritek s.s.a. it will contain the indication of the purchased Product / s; the indication of the price; the means of payment; of delivery costs. After the payment you will receive an e-mail that will notify you of the receipt of the payment and from that moment the timing for the preparation and shipment of your order will decorate. Should our staff find errors in your order or consider your order not to be processed within the time and in the manner requested, you will be promptly notified, which will indicate your order as REFUSED, if you should receive this message, please contact us at email address info@italiacbd.it. After 31 days from the creation of the order, the same will be automatically canceled by the system only when these expire. Any right of the Customer to compensation for damages or compensation is excluded, as well as any contractual or extra-contractual liability for direct or indirect damages to persons and / or things, caused by the non-acceptance, even partial, of an order or by the cancellation due to failure payment within the established deadline. In the product catalog published on the marymoonlight.com website, the availability of the products, even being constantly updated, may undergo variations not in real time and without notice. You are purchasing products that can be viewed and described on our site and you accept that the images of the products may not be perfectly representative of its characteristics but may differ in color and its shades, dimensions or accessory products shown in the figure.
 
Payment
The prices of the Products are expressed in Euros and include all applicable taxes and / or duties; The prices of the Products do not include delivery costs, the amount of which will in any case be indicated to the Customer in the summary of the purchase order; The price of the Product will be that indicated on the site at the time of the order. Therefore, they will not be able to detect any price increases or decreases, even in correlation with promotional sales before or after the purchase order. The customer can choose between the following three payment methods:
advance bank transfer;
credit / debit card;
cash on delivery (maximum amount € 500 including VAT).
Agritek s.s.a. does not accept other unspecified forms of payment.
 
Shipping
The delivery of the products will be made by courier and the times will vary depending on the destination, the time when the order will be acquired and the availability of the Product itself. For available goods, delivery will normally take place within the times indicated. Agritek s.s.a. is not responsible for any delays due to unforeseen events beyond its responsibility.
Our system will calculate your shipping costs based on some parameters dictated by the national courier and you can check the cost of your shipment at the end of the compilation of your order by reading the summary under "Shipping". Please carefully check the order summary and the costs listed to avoid running into problems of various kinds before sending your order and especially before payment.
Delivery times after shipment and any delays do not depend on Agritek s.s.a. who in any case undertakes to mediate and try to resolve any problems related to delivery with the courier. The Customer, by accepting our terms of use, exempts Agritek s.s.a. from any responsibility in this regard.
 
Warranty for defective goods
Should you find damaged goods inside your package, we invite you to send an e-mail to our address info@italiacbd.it within 24 hours of receiving the package, with attached photographic documentation relating to the damaged goods. The e-mail must also contain the reference of the order number. With the opening of the case we will proceed with the reimbursement of the cost of the goods or, if you prefer, a new shipment of the defective goods, all at our expense.
 
Right of withdrawal
Pursuant to art. 64 and following of the Consumer Code, the Consumer has the right to withdraw from the purchase without any penalty and without specifying the reason. To this end, he must send notice to Agritek s.s.a. by certified e-mail or registered letter with acknowledgment of receipt, to be sent within 3 working days from receipt of the Products.

For the purposes of the valid exercise of the right of withdrawal, the Consumer must comply with the following conditions and methods.
The withdrawal may also be applied limited to the individual Products covered by a single Sales Contract, it being understood that the Consumer cannot exercise the withdrawal limited to a part of the single Product purchased.
All the Products for which the Consumer has exercised the right of withdrawal must be intact like the original packaging, complete in all its parts including the packaging material, any seals affixed, as well as any ancillary documentation.
If the Product for which the right of withdrawal has been exercised is damaged by Agritek s.s.a, this will only be required to notify the Consumer in order to allow him, where possible, to exercise his right of recourse against the courier chosen for the return of products.
Agritek s.s.a. will not be liable under any circumstances for damage, theft or loss of returned products, until they have been returned. Any risk will therefore be borne exclusively by the Consumer.
Agritek s.s.a has the right to withdraw from each Sales Contract concluded by the Customer or by the Consumer, giving the same written communication by e-mail and registered letter with return receipt, as well as not accepting any Order from users or Customers who have implemented behaviors not regular, we have not accepted the Products purchased on delivery, are suspected of conduct contrary to the law.

Applicable law and dispute resolution
The contract between Agritek s.s.a. and the Customer is governed by Italian law.
In case of disservice or dispute between Agritek s.s.a. and the Customer, the Judge of the place of residence or domicile of the consumer will be competent if located in the territory of the Italian State.
For Customers domiciled in European Union states, Articles 15-17 EU Reg. 44/01.
